Meet Four Defense Witnesses for Conrad Murray

On August 29, 2011 an explanation of Conrad Murray's defense witness list was filed in L.A. Superior Court. A big thanks to Bridgett, who provided the link here to the document. Since we all know that Judge Pastor has barred many of the witnesses from testifying, we'll just examine four of the witnesses were ARE allowed to testify.

1. Dr. Allen Metzger:

This claim in itself is completely false according to police reports contained in Conrad Murray's search warrant affidavit. Murray claims that he administered Propofol for six weeks. This means that Murray started administering propofol on approximately May 14, 2009. This is an entire month AFTER the defense claims Dr. Metzger administered propofol to Jackson, IF TRUE AT ALL.

2. Dr. David Adams:

Dr. Adams is an ANESTHESIOLOGIST who administered propofol to Michael Jackson four times for dental procedures. Both the defense and the prosecution agree that Adams only administered propofol to Jackson four times. However, their timelines do not agree, as the defense claims Adams administered propofol in March or April, 2009, yet Adams claims in court documents he last worked on Jackson in December, 2008.
3. Cherilyn Lee

According to Lee's website, she is a holistic integrated health practioner. The defense wants to portray Jackson as a drug addicted, desperate man whose focus was on hunting for propofol, in a desperate attempt to fight insomina. However, Cherilyn Lee told Access Hollywood in July, 2009, that “Mr. Jackson did not present himself as a drug addict and from January to April, I didn’t see that in him,” Lee told Access. “Even when it came to the Diprivan, he was looking for something that was going to help him sleep." Cherilyn Lee is stating what Jackson fans already know; that Jackson was not a drug addict, underscored by his autopsy report that showed no drugs in his system at the time of death other than propofol, lidocaine and a trace amount of a benzodiazepine.

4. Karen Faye

Karen Faye was Michael Jackson's longtime stylist. Faye maintains that Jackson was weak, frail and drug addicted in the week prior to his death. However, Jackson's autopsy report states otherwise. At death, Michael Jackson weighed 136 pounds and had no drugs in his system other than propofol, lidocaine and a trace amount of benzodiazepine.

Faye also maintains that Jackson was upset about the amount of shows that he was contracted to do with AEG Live for the This Is It tour. Yet, the Lloyd's of London policy, issued to AEG Live for Michael Jackson, indicates that the contract was originally for 30 shows, not 10.

Lastly, for those who intimate that Jackson was wearing heavy coats, while the backup dancers and musicians were wearing shorts sleeves, apparently this was a habit for Michael. See this video, during the Bad Tour, Michael is wearing a coat, while the others are in mere sleeves. (Thanks, my friend, for pointing this out.)

As for Dr. Adams, he says he last worked on Michael December 2008 (if true), this is 6 months (not 1.5 years) prior to Michael's passing.

I know many fans are having a problem with nurse Lee but she maybe a key witness for the case, There is an interview where she state that MJ only wanted the drug to sleep.
As for the defence motion they seam to spice up there talk about MJ the so called "drug addict"
now when there clint are force to tell the truth about what happen on June 25 from midnight to morning. They want to question other doctors? They are screaming about locking up the jury because Murray don't want them poison?
If jury in 05 was not poison toward MJ himself, but sit down and listen to the case found MJ not guilty on 14 count of false charges.
Then CM have nothing to worry about, if the jury are not poison already from leaks Murray and his PR people throw out there trashing MJ calling him a drug addict, saying he kill himself , so who is trying to poisoning the jury?

Watch TII. The dancers all wear sweats or dance pants and layered tops, including a few who had jackets on too.

You can tell I was tired when I wrote this blog lol...thanks Blanaid for the correction. Jury sequestration may delay the trial, that's what worries me most at this point.

You know there's difference btw a favorable witness for the defense and being subpoena by the defense. Unless one of the four is going to claim drinking propofol is an easy thing to do or say MJ told them he planned to kill himself doing so I don't see a need to sweat this. If Mike didn't kill himself in 04 or 05 thinking he'd go to jail forever and lose everything then why think he'd this time? You Fans need to stop reading the crazy Tabs stop jumping at every crazy story they print.

Anonymous,

I think we're all aware that these four witnesses would be considered hostile by the defense. However, that was not the point of the blog. The intention is to inform those who are unaware, that's it. This isn't jumping at crazy tabloids, these witnesses have already been deemed as fair game by Judge Pastor.

Bridgett, I hear you about the jury sequestration. I read that the State of Florida spent $350,000 to sequester the Casey Anthony jury. The state of California cannot afford this, and I would hope the appellate court rejects the defense's theory that the jury must be sequestered in order for Murray to get a fair trial. It doesn't seem fair that MJ didn't get a sequestered jury in '05, does it? It also makes me wonder if what HLN said was true, that Jose Baez and Cheney Mason, defense attorneys for Casey Anthony, are advising the Murray defense.

You're doin' wrong..yes, I hear you. One of the songs though has MJ in a black jacket, black sweat pants, and the dancers in short sleeves. Of course, we remember when everybody ran with that story saying that MJ was cold all the time, but the other dancers were hot. SMH at the theory that MJ was sickly, when clearly the autopsy says otherwise.

Anonymus: I think most people know the witnesses did not asked to be subpoened but they were! Of course I have my opinion on that which I will keep to myself! Your doing Wrong: Joe Jackson and Brian Oxman and several news casters made a big issue out of MJ wearing layers and layers of clothes and Jackets during TII, when other dancers were in Short sleeves. I believe what and Justice was trying to show is that MJ wore Jackets and heavy clothes during reheasals numerous times and people should not read into this as a sign that something was wrong. The bottom line here is to make sure all remember why Murray is on trial and stay focused. He administered a drug out of a hospital setting, without the correct monitoring equipment and to add insult to injury left his patient unmonitored. Stay Focused !
AND JUSTICE THANKS FOR STAYING FOCUSED ON WHAT MATTERS!

Great catch re MJ's preference for coats/layers during rehearsals.

For those unfamiliar, I wanted to add the allegation by Murray that Dr. Adams used Propofol on Michael in March or April of 2009 which Dr. Adams has since denied:

Murray Affadavit, PDF page 11, lines 7-13:

"MURRAY also recounted how sometime between March and April of this year [2009], JACKSON called him in Las Vegas and asked him to call Doctor DAVID ADAMS and arrange for Doctor ADAMS to give JACKSON PROPOFOL (DIPRIVAN). MURRAY did as JACKSON asked and arranged for Doctor ADAMS to treat JACKSON. MURRAY was present at a third party cosmetologist's office where Doctor ADAMS sedated JACKSON with PROPOFOL (DIPRIVAN). MURRAY stated this was around the time that JACKSON requested him to be his personal physician on the European tour."

Please let's keep focus on Murray's egregious acts which resulted in Michael's death; I do not believe these hostile witnesses will be of any benefit to the defense. And I would still like to know who is paying Flanagan, Chernoff, Gourgian, et al. to defend this guilty party. Judge Pastor refused sequestration several weeks ago so why wait until September 2nd to go to appellate court? Defense should have filed for appellate review THEN, not wait weeks. If app court refuses to hear, what will defense do next, try to get appellate review of Pastor's witness exclusion? Another delaying tactic as their client has NO defense.

Sandy K
What Karen Faye has said has nothing to do with whether or not Murray administered Propofol. Whether he was thin...not on his game 100% is even more reason why Murray should not have given MJJ Propofol!

Stop changing the subject!

Matter is one thing Murray administered a drug, out of a hospital setting, without the correct monitoring equipment and to add insult to injury left his patient unmonitored. Stay Focused !

r.c.villanova, you are absolutely right. The focus is Murray and ONLY Murray. To this end I have been consistant. My intention was not to change the subject, only to add information. Staying focused is critical. Thanks for the reminder. Blessings to you always.

according to the documents:
the PEOPLE v. MURRAY
MOTION IN LIMINE REGARDING PROPOSED DEFENSE WITNESSES
[*filed 8/25/11 by David Walgren, Deputy DA]

http://ww2.lasuperiorcourt.org/hp/adl0xt45qzi15p3ydr2hec45/1467859115.pdf
...

1. Allen Metzger [lupus specialist]
the Coroner issued a subpoena to Dr. Allen Metzger and both the People and the defense are in receipt of the responsive medical documents. according to medical records, Metzger:
- saw MJ one time in 2002 (physical examination)
- saw MJ one time in 2003 (preoperative examination)
- had a telephone call w/ MJ one time in 2008; one time in Feb. 2009
- saw MJ in April 2009 (no physical exam; deemed MJ to be fit, trim, and and lucid; MJ inquired about sleep medicine; noted will prescribe Klonopin or Trazadone)

according to the defense, they had not interviewed this witness.

*side note: according to search warrant/AR, among the meds found in MJ's rental home was indeed a prescription from Metzger for Trazadone (often used for the treatment of insomnia.)
Date of Issue: 4/18/2009
Directions: 2 at bedtime as needed
Number issued: 60
Number remaining: 38
This evidence was logged in on 6/26/09 (which means that if taken as directed, MJ may have taken the med for about 11 nights)

*the point is, according to physical evidence, Metzger prescribed the medication to treat MJ's insomnia.
----------

3. Karen Faye [MJ's make-up and hair stylist]
Faye was interviewed by detectives.
- she indicated MJ was in poor health one week prior to MJ's death, **but that he looked great on June 23 and June 24, 2009

according to the defense, they have not interviewed this witness.

as for MJ wearing layers while his dancers appear to be in lighter clothing, MJ wasn't exactly dancing around like his dancers were, either.

regardless, check out the coat on MJ circa Bad era:

Jaker.

If this came to trial in any other country, the verdict would be “Misadventure” & Dr Murray would be free, it mightn’t even have gone to trial in the first place.

Re; Jackson,
Jackson was on drugs since the eighties, at the time he bought a monkey & was having all those trials re; children in his bedroom & there was an amazing media hype regarding him being a paedophile. There was lots of drugs since & plastic surgery & God knows what else? But his family, are not out any of the blame either, they knew he was on all these things during the years & did nothing to help him, also his security men knew as well.

Also, many doctors before Dr Murray were feeding him drugs, so many drugs that for years, he couldn’t show his face because all those drugs/plastic surgery since he started taking drugs in his younger life started affecting his features. it’s all there, you don’t need to be too intelligent to know that this man Michael Jackson would reach far longer than when he did die, no matter what Doctor was attending him. So people, don’t be just jumping on Dr Murray, he was doing the best he could in the circumstances that came about on the day of his death.

It was God’s decision in the end. But all those years of drug-taking all his life brought him to that point as well as all the pressures of being made do 50 concerts at fifty when it was only supposed to be ten. His life was a mess (literally) the man (Jackson) had such a stressful life phase & being an insomniac – it’s a bad mix. So in adding everything up I could never accuse Dr Murray of having anything to do regarding Michael Jackson’s death.

In fact – Michael Jackson was on the way to his early death after taking his first drug/s, when-ever that was in his sad personal life. Yes, he was a great performer & world star, but he was not infallible. He was just like the rest of us – just plain old “Human”. & Humans die – sometimes helped on by themselves. That’s sad, but it is true, it’s happening as I write the world over, & no-one will hear of all those deaths, or there’ll be no court case with fancy lawyers & smart talking doctors for any of those unknown…out of sight…out of mind people who have met that fate.

But this was/is Michael Jackson, & only for that reason alone, he has got his trial without his presence, because his family have money & all the rest of it. A doctor who took the Hippocratic act like every other doctor, is paying for it, because he was there being a doctor – trying to save his patient who was dying in front of him, he probably never even thought this was going to be this kind of day, but it was & he is paying for it. The other doctor’s with all their attitude haven’t a clue as to what he faced up to on that day, or what the world would hear that day/night. But as the old saying goes “Hindsight is a wonderful thing”!
